Official Rules

NO PURCHASE NECESSARY TO ENTER OR WIN.  A PURCHASE DOES NOT INCREASE YOUR CHANCE OF WINNING.  VOID WHERE PROHIBITED. 

The Open My Safe 1 Instant Win Game and Sweepstakes (the "Promotion") begins at 3:00 P.M. Eastern Time (ET) on Friday June 4, 2010 and ends at 11:59:59 P.M. Eastern Time (ET) on Wednesday September 1, 2010 (the “Promotion Period”). Entry in the Promotion does not constitute entry into any other promotion, sweepstakes or contest sponsored by REALTIME MEDIA, INC (“Sponsor”) or its affiliates. By participating in the Promotion, each entrant unconditionally accepts and agrees to comply with and abide by these Official Rules and Sponsor’s decisions, which decisions shall be final and binding in all respects.

1. ELIGIBILITY: The Promotion is open only to legal residents of the 50 United States and the District of Columbia (includes Alaska and Hawaii) who are 13 years of age or older at the time of entry.  Do not participate in the Promotion if you are not physically located in the United States at the time you enter the Promotion. The Promotion shall be governed exclusively by the federal and state laws of the United States.  Employees, officers and directors of Sponsor, Teton Innovations, RealTime Media, Inc. (the “Administrator”), together (the “Promotion Entities”), their respective parents, affiliates, subsidiaries, divisions, advertising, Promotional, fulfillment and marketing agencies, their immediate families (including parents, children - whether step children or adoptive children or biological children, siblings, spouses and in-laws) and persons living in the same household as such individuals (whether related or not) are not eligible to participate in the Promotion. Void in Puerto Rico, all other territories and where prohibited by law, rule or regulation.  All federal, state and local laws and regulations apply.

 

1. HOW TO ENTER:  Limit of one (1) registration per person/email address for the Promotion Period. Subsequent registrations from the same person and/or email address will be disqualified. For the purposes of the Promotion, a day shall mean a 24-hour period, beginning at 12:00:00 AM Eastern Time (“ET”) and ending at 11:59:59 PM ET with the exception of the first day of the Promotion Period which begins 3:00 PM ET. RealTime Media’s clock will be the official timekeeper for this Promotion. Any attempt by a person to use multiple email accounts to enter more than once may result in disqualification at the discretion of the Promotion Entities.

To register for the Promotion go to http://www.openmysafe.com (the "Website") during the Promotion Period.  You must provide a valid email address and password.  Check to make sure that you correctly entered information in all required fields on the registration form.

Upon successful registration you will receive one (1) Sweepstakes entry and ten (10) Instant Win Game Plays automatically and each day upon login thereafter.  You can earn bonus Instant Win Game Plays and Sweepstakes entries through the Tell-A-Friend (“TAF”) program and by providing demographic information. 

Tell-A-Friend: Once on the Tell-A-Friend page, you can receive five (5) Bonus Instant Win Game Plays and one Sweepstakes entry for each valid, unique e-mail addresses of friends/family members that register for the Promotion from the TAF communication. 

Demographic Information: Registrants will be given a second opportunity to earn a Bonus Instant Win Game Play and Sweepstakes entry by clicking on the “Earn More Attempts” button and providing true and correct demographic information.

Unused Game Plays will expire at 11:59:59 PM ET of each day of the Promotion Period. Unused Game Plays will not be rolled over from day to day. Bonus Instant Win Game Plays will exist until they are used. Limit of 50 Bonus Instant Win Game Plays at any given point.

To play the Instant Win Game the user will select four numbers to potentially open the safe. Game is not skill-based. If you submit four numbers at a randomly selected winning time (as determined by Sponsor) or if no one submits four numbers at such time and you are the first to play thereafter (as determined by Sponsor), you are a potential Instant Prize winner. If you are a potential Instant Prize winner (prize award subject to verification of eligibility, winning Game Play verification & compliance with Official Rules terms), you will see a winner’s confirmation page.

To claim a prize, winners must submit their full name and mailing address to the Web Site. Only the authorized account holder of the email address at time of registration may play an Instant Win Game. In the event of a dispute regarding the identity of any potential winner, Sponsor will award the prize to the authorized account holder who is defined as the natural person assigned to the email address by its Internet access provider, online service provider or other organization that is responsible for assigning email addresses or the domain associated with the submitted email address. Sponsor may require a potential winner to provide the Sponsor with proof that the potential winner is the authorized account holder of the email address associated with the winning entry.  Sponsor may disqualify the entry if the information the potential winner provides to Sponsor is not satisfactory to Sponsor.  Entries generated by a script, macro or other automated means will be disqualified. Entries that are incomplete garbled or corrupted are void and will not be accepted. Except as noted in these Official Rules, information collected for this Promotion is used only for the purpose of winner notification, and will not be re-used, sold or shared in any manner by Promotion Entities or any third parties unless participant has elected to receive additional information and promotional material from the Sponsor or a third party.  By participating in the Promotion, participant (and, if an eligible minor, his/her parent or legal guardian) agrees to all of the terms and conditions of the Sponsor’s Privacy Policy, which is available at: http://www.openmysafe.com/privacy.html. All entries must comply with these Official Rules and each winner must provide the information required in order to claim a prize. The Administrator will review each winning entry and the information submitted by the winner. If the Administrator determines that the entry or the information submitted by the winner does not conform to these Official Rules, the Administrator will void the entry and the winner will forfeit his or her prize.

1. INSTANT WIN GAME AND SWEEPSTAKES PRIZES AVAILABLE and OPPORTUNITITY OF WINNING: There are a total of 93 prizes available in the Promotion. Odds of winning a prize in the Promotion depend on the number of eligible entries received.

 

Instant Win Prize: Quantity/Description

One (1) $10,000.00 prize check.

One (1) $5,000.00 prize check.

Ninety (90) $500.00 Visa gift cards.

Total Approximate Retail Value of all Instant Win prizes is $60,000.

Sweepstakes Prize: Quantity/Description

One (1) $10,000.00 prize check.

Total Approximate Retail Value of all Promotion prizes is $70,000.

 

1. PRIZE AWARDING: The Promotion Entities will award the prize only upon winner confirmation, verification and final approval.  The potential winner (and, if eligible minors, their parents or legal guardians) may be notified by phone or e-mail and will be required to satisfactorily complete an Affidavit of Eligibility, a Liability and Publicity Release, and W9, all of which must be returned to RealTime Media within ten (10) days of date of issuance of winner notification. If a potential winner cannot be contacted within a reasonable time period; is ineligible; fails to return the required documents, if the prize notification is returned undeliverable; or if a potential winner otherwise fails to fully comply with these Official Rules, he/she will forfeit that prize and the prize may be awarded to an alternate winner as selected by the Promotion Entities. Multiple entrants are not permitted to share the same email address. Any attempt by any entrant to obtain more than the stated number of plays/entries by using multiple/different email addresses, identities, registrations and logins, or any other methods will void that entrant's plays/entries and that entrant may be disqualified. Sponsor will only award a prize after verifying the entry and the winner’s information comply with these Official Rules. Winners may not request a substitute prize, request the cash equivalent of the prize, or transfer or assign their prize. All prizes will be shipped to winners 2-4 weeks after the potential winner verifies their correct information. Potential winners will be deemed an official winner after verification is complete.

In no event will more than the number of prizes stated herein be awarded. Winners are responsible for all federal, state and local taxes as well as all costs and expenses associated with prize acceptance and use not specified herein as being awarded. No substitution, cash redemption or transfer of any prize (or portion thereof) is permitted, except by the Promotion Entities who reserve the right, in their sole discretion, to substitute a prize (or portion thereof) of comparable or greater value.  Prizes are awarded “as is” with no warranty or guarantee, either express or implied by Sponsor.  Any portion of a prize not accepted by winner will be forfeited. If any winner is considered a minor in his/her jurisdiction of residence, prize will be awarded in the name of his/her parent or legal guardian who is responsible for fulfilling all requirements imposed on winners set forth herein.  All prize details are at Sponsor’s sole discretion.

1. RIGHT OF PUBLICITY: Except where prohibited or restricted by law, each winner (and, if an eligible minor, his/her parent or legal guardian) grants the Promotion Entities the right to use and publish winner's full name and state of residence online in connection with the Promotion. By accepting a prize, each winner grants the Promotion Entities permission to use winner's name and likeness solely for advertising and promotional purposes as Sponsor deems appropriate without notice or further compensation.

 

1. DISQUALIFICATION: The Promotion Entities may disqualify any entrant found tampering with or abusing any aspect of this Promotion. If the Promotion Entities disqualify an entrant for any reason the entrant may not participate in the Promotion or claim a prize. Any attempt by any person to undermine the legitimate operation of the Promotion may be in violation of federal or state criminal or civil law. Should any person make such an attempt, Sponsor may seek damages or other relief against such person as permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that term. Sponsor reserves the right to terminate, cancel, suspend and/or modify the Promotion if any fraud, virus or other technical problem corrupts the administration, security, or proper play of the Promotion, as determined by Sponsor in its sole discretion. In such event, Sponsor reserves the right to award the prizes in a random drawing from among the eligible, non-suspect entries received up to the time of the impairment.  If for any reason more entrants receive an “instant winner” notice than the number of prizes stated herein, Sponsor reserves the right to award only the number of prizes stated in the Official Rules via a random drawing from those entrants who received an “instant winner” notice.  In no event will more prizes be awarded than those listed in the Official Rules.

1. LIABILITY & RELEASE:  By participating in the Promotion, entrants (and, if eligible minors, their parents or legal guardians), agree to release and hold harmless Sponsor, Administrator and their respective affiliates, shareholders, directors, officers, distributors, employees or agents (collectively, the (“Promotion Entities”) from and against any claims or causes of action arising out of or in connection with participating in the Promotion or receiving or using any prize, including, but not limited to: (a) unauthorized human intervention in the Promotion; (b) technical errors related to computers, servers, providers, or telephone or network lines; (c) printing errors; (d) lost, late, postage-due, misdirected, or undeliverable mail; (e) errors in the administration of the Promotion or the processing of entries; or (f) injury or damage to entrant or other persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Promotion or receipt of any prize.  Entrant further agrees that in any cause of action, the Promotion Entities’ liability will be limited to entrant’s cost of entering and participating in the Promotion, and in no event shall the Promotion Entities be liable for entrant’s attorney’s fees.  Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.

 

1. TAX INFORMATION; LEGAL FILINGS: All applicable federal, state, local, and other taxes (income or otherwise) on prizes are the sole responsibility of the applicable winner. Sponsor will furnish the appropriate state agencies with winners’ names and addresses and other pertinent information, if required by law.

1. DISPUTES: Except where prohibited by law, entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Promotion or any prize awarded shall be resolved individually, without resort to any form of class action. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant’s rights and obligations, or the rights and obligations of the Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with applicable federal and state laws and regulations. All decisions of Sponsor or Administrator shall be binding and final.
